Picture Copyright Laws- Nonprofit Newsletter.?

Is it alright to publish pictures in a online nonprofit community news letter if they say “>Person’s Name< Copyright 2010?" in the bottom of each picture?

They are video game screenshots.
I sent out an email to the person in question but he hasn't replied and we are approaching our deadline :/
Also we didn't addd the person's name it was already on the screens.

Simply adding “>Person’s Name< Copyright 2010" doesn't give you rights to use the photos. If the newsletter is a about gaming then it would probably considered fair use.
